Media Release & Licensing

This Media Release ("Release") is entered into by the participant, client, and any guests appearing in photographs or video (collectively, the "Subject") and KEP1 Photo by KSPORT, Inc., a New Jersey corporation ("KEP1 Photo"). It is governed by the laws of the State of New Jersey, including the common-law right of publicity recognized in Palmer v. Schonhorn Enters., Inc., 96 N.J. Super. 72 (Ch. Div. 1967), and related authority.

1. Grant of Rights

Subject to the choice indicated at booking, the Subject grants KEP1 Photo, and its successors, assigns and licensees, an irrevocable, perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, edit, publish, exhibit, distribute, and display the photographs, video, and other likenesses captured during the engagement (collectively, the "Materials") for the following purposes:

• Portfolio, website, and printed marketing materials.
• Social media accounts operated by KEP1 Photo (including Instagram @ksport1).
• Editorial features, industry publications, and photo competitions.
• Advertising and promotion of KEP1 Photo's services.

2. Right to Decline Promotional Use

The Subject may decline promotional use at the time of booking. If declined, KEP1 Photo will deliver the Materials privately and will not publish them in the categories listed above. Copyright in the Materials remains with KEP1 Photo in all cases.

3. Minors

For any Subject under the age of eighteen (18), a parent or legal guardian must acknowledge this Release on the minor's behalf. The parent or guardian represents and warrants they have full authority to do so. Minors' images are given heightened care; requests to remove published imagery of a minor will be honored promptly upon written request.

4. Copyright Ownership

All Materials are original works of authorship owned exclusively by KEP1 Photo under 17 U.S.C. § 101 et seq. Delivery of files or prints does not transfer copyright. Any use outside the personal, non-commercial license granted at delivery requires a separate written license.

5. Licensing Tiers (Info Only)

The following licensing tiers are set by the photographer and are provided for informational purposes. Final fees depend on scope, distribution, territory, exclusivity, and duration. To request licensing, use the contact form and select "Licensing."

• Personal / Social — Included with delivery. Personal, non-commercial use only.
• Editorial — Use in non-advertising editorial contexts (news, blogs, magazines). Starting at $150 per image.
• Commercial — Use in advertising, product marketing, or paid promotion. Starting at $500 per image, term-limited.
• Extended Commercial / Buyout — Broad or exclusive commercial rights across media and geography. Quoted per project.

All licensing fees, terms, and durations are set by the photographer and confirmed in a written licensing agreement before use.

6. Withdrawal of Consent

The Subject may request removal of Materials from KEP1 Photo–operated channels at any time by writing to kport1@gmail.com. KEP1 Photo will remove the Materials within a reasonable period. Third-party republications and previously printed materials cannot be recalled.

7. No Compensation

Unless otherwise agreed in writing, the Subject acknowledges no additional compensation is due for the promotional uses described above beyond the photography fees paid for the event.

8. Governing Law & Venue

This Release is governed by the laws of the State of New Jersey. Any dispute shall be resolved exclusively in the state or federal courts located in Essex County, New Jersey.

9. Acknowledgment

By completing a booking and checking the acknowledgment box, the Subject (and, for minors, the parent or legal guardian) confirms they have read, understood, and agreed to this Release. A copy of the signed acknowledgment is retained with the booking record.
